Obasanjo Files Notice Of Appeal

Olusegun Obasanjo, the former president of nigeria has appealed before the Federal High Court in Abuja that orders his book to be seized for disobeying an injunction restraining him from publicising his book 'MY WATCH'.

He blamed the media for the report that he dares the judge, he said the report is misleading.

The presiding judge Valentine Ashie on wednesday said irrespective of the public presentation, obasanjo made a mistake by not obeying his orders.

It would be recalled that the south west leader of the people democratic party has sought legal actions against some sections of the book.

Obasanjo's counsel Gboyega Oyewole has filed an appeal challenging the confiscation order and he is declaring a 10 grounds of appeal.

The suit was numbered CV/472/14, which a copy was made available to reporters in Abeokuta, the counsel said his client was not satisfied with the judgement of the high court and has appealed against it.

According to THE NATION, the counsel grounds of appeal bordered on the believe that the learned trial judge erred in law when he granted Interlocutory orders of injuction which among other things restrained obasanjo from the publication of his book or the content of the letter which is the subject of the suit before the trial judge in the book.

He also stated that there was incontrovertible affidavit evidence that the defendant's book had been published and released to the public before the making of the order.

The lawyer also argued that the plaintiff never alluded to this fact in his affidavit before the court.

It is a settled law that an injuction does not lie to restrain a completed act.

His lordship failed and/or neglected to allude to the affidavit evidence before making the interlocutory order.
